Terms of Service

01 — GENERAL

By accessing or using the website at ucatready.com.au (“the Site”) and any services, content, or products provided by UCATReady Pty Ltd (ABN 84 695 691 804) (“UCATReady”, “we”, “us”, or “our”), you (“you” or “the User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must not access or use the Site.

The products and services available through the Site are limited to individuals who are legally capable of entering into binding contracts under applicable Australian law. If you are under the age of 18, you must have the consent of a parent or legal guardian to use the Site and purchase any services.

UCATReady reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.

02 — ACCOUNT REGISTRATION

To access certain features of the Site, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information up to date.

You are responsible for safeguarding the credentials used to access your account and for any activity that occurs under your account. You must notify UCATReady immediately of any unauthorised use of your account or any other breach of security.

You may not create more than one account per person. If UCATReady reasonably believes that you have created multiple accounts to circumvent usage restrictions or benefit from promotional offers more than once, we may suspend or terminate your accounts and charge standard fees where applicable.

03 — FEES AND PAYMENT

You agree to pay all fees associated with the plan or service you select (“Fees”) in accordance with the prices and terms displayed on the applicable pricing page at the time of purchase, or as otherwise agreed in writing.

All Fees are quoted and payable in Australian Dollars (AUD). Fees are charged on a recurring basis (weekly or annually, depending on the plan selected) and will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

UCATReady reserves the right to correct pricing errors and to change its prices at any time by posting notice to your account or the Site. Any price changes will apply to Fees charged after the effective date of the change and will not affect Fees already paid.

If you wish to dispute any Fees, you must contact us at support@ucatready.com.au within 72 hours of the date of the disputed charge. If any Fees remain unpaid beyond their due date, UCATReady may suspend your access to the services after providing reasonable notice.

04 — REFUND AND CANCELLATION POLICY

All payments are non-refundable except where the service is seriously defective or otherwise required by Australian Consumer Law.

The following do not constitute grounds for a refund: change of mind, failure to achieve a desired UCAT score, accidental purchase, non-use or underuse of the service, expiration of a subscription period, unused promotional or discount codes, or circumstances outside UCATReady's control (including but not limited to internet outages, device failure, or changes to the UCAT exam format by the test administrator).

If you believe you are entitled to a refund under Australian Consumer Law, you must submit a written request to support@ucatready.com.au within seven (7) days of the relevant transaction, including your account details, transaction history, and a detailed explanation of the issue. All approved refunds may incur a processing fee of up to 20% to cover administrative and payment processing costs.

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of the current billing cycle, and you will retain access to the service until that date. No partial refunds are provided for unused portions of a billing period.

05 — DELIVERY OF SERVICES

All UCATReady services are delivered digitally via the Site. Upon successful payment and account activation, you will have immediate access to the features included in your selected plan.

You are responsible for ensuring that the email address associated with your account is correct and that you have a suitable internet connection and device to access the platform. UCATReady is not liable for any failure to deliver services resulting from incorrect account information provided by you.

Access to the platform, including practice questions, mock exams, walkthroughs, and analytics, is available for the duration of your active subscription. UCATReady reserves the right to modify, update, or discontinue any features of the service at any time, with or without notice.

06 — ACCEPTABLE USE

You agree not to use the Site or services to:

  • Upload, transmit, or distribute any material that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
  • Send unsolicited advertising, promotional material, or spam to other users.
  • Upload or transmit any software viruses, malware, or other harmful code.
  • Scrape, crawl, or otherwise extract content from the Site for the purpose of creating commercial databases, competing products, or derivative works.
  • Resell, redistribute, sublicense, or share your account access or any content from the Site with third parties.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices on the Site.
  • Engage in any activity that could damage UCATReady's reputation, disrupt the Site's operation, or interfere with other users' access to the service.

UCATReady reserves the right to investigate and take appropriate action against any user who violates these provisions, including without limitation suspending or terminating the user's account without a refund.

07 — INTELLECTUAL PROPERTY

All content on the Site — including but not limited to practice questions, walkthroughs, mock exams, text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, software code, and the design, structure, selection, and arrangement of such content — is owned by or licensed to UCATReady Pty Ltd and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and its content solely for your personal, non-commercial educational purposes. You may not reproduce, modify, distribute, republish, display, transmit, sell, or create derivative works from any content on the Site without prior written consent from UCATReady.

Sharing your account credentials, screenshots of questions or walkthroughs, or any other proprietary content with third parties — whether for personal, coaching, or commercial purposes — constitutes a breach of these Terms and may result in immediate termination of your account, forfeiture of any remaining subscription period, and potential legal action.

08 — LICENSING

Each UCATReady subscription is a single-user licence intended for use by one individual only. This licence is non-transferable, non-shareable, and non-resellable. Any attempt to share, transfer, or resell access to your account or its content constitutes a breach of copyright and these Terms.

09 — TERMINATION

You may terminate your account at any time by contacting us at support@ucatready.com.au or through your account settings.

UCATReady reserves the right to suspend or terminate your account at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to UCATReady, other users, or third parties. In the event of termination for cause, no refund will be provided.

10 — INDEMNIFICATION

You agree to defend, indemnify, and hold harmless UCATReady Pty Ltd, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your use of the Site or services; or (c) any dispute between you and a third party relating to your use of the Site.

11 — LIMITATION OF LIABILITY

To the maximum extent permitted by Australian law, UCATReady shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site or services, whether based on warranty, contract, tort, or any other legal theory.

In no event shall UCATReady's total aggregate liability to you for all claims arising out of or related to these Terms or your use of the services exceed the total amount you have paid to UCATReady in the twelve (12) months preceding the claim.

12 — DISCLAIMER

The Site and all services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

UCATReady does not guarantee that use of our platform will result in any particular UCAT score or outcome. Your results depend on many factors including your individual ability, the amount of preparation you undertake, and your performance on test day.

UCATReady is not affiliated with, endorsed by, or associated with Pearson VUE, the UCAT Consortium, or any Australian university. The UCAT is a registered trademark of the UCAT Consortium. UCAT registration and test administration are the sole responsibility of the student.

13 — COMPLAINTS AND DISPUTES

If you have a complaint about the service, please contact us at support@ucatready.com.au with a clear description of your concern. We aim to acknowledge all complaints within two (2) business days and provide a resolution or detailed response within ten (10) business days.

If a complaint cannot be resolved through our internal process, you may seek external mediation through a mutually agreed independent mediator. These Terms are governed by the laws of the State of Western Australia, and any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.

14 — GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Western Australia. You irrevocably submit to the exclusive jurisdiction of the courts located in Western Australia for the resolution of any disputes arising under these Terms.
